What you need to know and consider about the NY HERO Act

The passage of the New York Health and Essential Rights Act (“NY HERO Act”) that will go into effect on June 4, 2021 is intended to help stop the spread of infectious diseases such as COVID-19 and other viral or bacterial diseases. The NY HERO Act is broadly defined to include any business, corporation, limited liability company or partnership.

While the overarching intent to is help increase workplace safety for companies and employees by creating a prevention plan and workplace safety committees, there are other employment-related exposures that are created and need to be addressed.

The NY HERO Act protects employees from discrimination or retaliation for employees who report violations of the safety plan or of their rights under the plan. It also protects employees who refuse to work if they sincerely believe there is a present danger to exposure of COVID-19 and other diseases.
